TERMS & CONDITIONS
Terms and Conditions
These Terms and Conditions govern the relationship between you (the “Client”) and our company (referred to as “we,” “our,” or “the Company”), a registered travel agency based in Peru, specializing in trekking, daily tours, climbing expeditions, and multi-day packages across various Peruvian destinations. By booking with us, you acknowledge that you have read, understood, and agreed to be legally bound by these terms.
1. Booking and Payment Policy
1.1 Booking Confirmation: All bookings must be submitted through our official website or in writing via email. A booking is only confirmed once the deposit has been received and a confirmation email has been sent.
1.2 Deposit Requirement: A non-refundable deposit of 30% of the total trip cost is required at the time of booking. This deposit guarantees your place and allows us to make necessary arrangements in advance.
1.3 Full Payment: The remaining balance must be paid no later than 15 days before the trip departure date. Failure to do so may result in cancellation without refund of the deposit.
1.4 Payment Options:
- Online Payment: Secure credit/debit card payments through our website.
- Bank Transfer: Direct transfer to our Peruvian bank account. Bank details will be provided upon request. Clients are responsible for all bank charges.
2. Cancellation and Refund Policy
2.1 Client Cancellations: All cancellations must be submitted in writing via email.
- 30+ days before departure: Refund of total payment minus deposit and bank/processing fees.
- 15–29 days before departure: 50% refund of total payment (deposit non-refundable).
- Less than 15 days before departure: No refund will be issued.
2.2 Company Cancellations: In the rare event that we must cancel a trip due to weather, low bookings, or unforeseen circumstances (e.g. strikes, natural disasters), you will be offered a full refund or the option to reschedule. We are not responsible for costs such as airfare, insurance, or visa fees.
3. Travel Insurance
Travel insurance is mandatory for all participants. Your insurance must cover:
- Trip cancellation and interruption
- Medical and emergency evacuation
- Accidents and illness (including COVID-19)
- Lost or stolen luggage
Clients are responsible for ensuring their insurance is valid and adequate. Proof of insurance may be requested before the trip begins.
4. Health, Fitness, and Risk Awareness
4.1 Fitness and Medical Conditions: Some of our tours involve high-altitude trekking, climbing, or long physical exertion. It is your responsibility to assess whether you are physically fit and healthy enough to participate. Please consult with your physician if unsure.
4.2 Altitude and Acclimatization: Several of our destinations are above 3,000 meters (9,800 feet). We include acclimatization strategies, but clients must acknowledge the risks associated with high-altitude travel.
4.3 Assumption of Risk: Participation in outdoor and adventure activities involves inherent risks. By booking a trip, you voluntarily accept these risks and release our company from liability in the case of personal injury or property damage unless caused by gross negligence.
5. Itinerary Modifications
5.1 Flexibility Required: Itineraries may be subject to change due to weather conditions, road closures, strikes, or other unforeseen events. We will make reasonable efforts to maintain the program, but reserve the right to alter or cancel parts of the itinerary without prior notice for safety or logistical reasons.
5.2 No Refunds for Missed Activities: Refunds will not be issued for missed services or activities due to delays, weather, or personal reasons.
6. Pricing and Surcharges
6.1 Price Inclusions: Each trip includes services as stated on the specific trip page: guides, meals, transportation, entrance fees, accommodation, etc.
6.2 Exclusions: Personal expenses, travel insurance, alcoholic beverages, tips, international airfare, and items not specifically mentioned are not included.
6.3 Surcharges: We reserve the right to apply surcharges due to exchange rate fluctuations, government taxes, or fuel increases. Clients will be informed in advance.
7. Documentation and Travel Requirements
7.1 Passports and Visas: It is the client’s responsibility to carry a valid passport and any necessary visas. We will not be held liable for denied entry or missed flights due to incomplete documentation.
7.2 Vaccinations: Clients are encouraged to check with their health provider for up-to-date information on vaccines (e.g. Yellow Fever for the Amazon region).
8. Client Behavior
8.1 Code of Conduct: We expect respectful and cooperative behavior from all clients toward our staff, fellow travelers, and local communities. Any form of harassment, intoxication, or disruptive behavior may lead to removal from the tour without refund.
8.2 Environmental Responsibility: We promote sustainable travel and ask all clients to respect nature and cultural heritage sites by following Leave No Trace principles.
9. Use of Photos and Videos
During your trip, guides may take photos or videos for promotional use (website, social media, brochures, etc.). If you prefer not to be included in such media, please inform us in writing before your trip begins.
